Terms of Sale


Property in any goods delivered by L&P PHOTOGRAPHIC SUPPLIES PTY LTD (“THE SELLER”), will not pass to the Buyer (and the buyer shall be a bailee only in respect of such goods and shall hold the same as fiduciary for the Seller) until the buyer has paid the whole of the purchase price to the Seller. Until fully paid for the Buyer will, if required, store each item of goods delivered by the Seller in such a way that it is clearly identifiable as the property of the Seller.

Prior to the Buyer acquiring property in any goods the Buyer may only sell the same within the normal course of its business and on the condition that if the Seller requires, the purchaser shall hand over to the Seller the sale price or (for a credit sale) the claims that it has against its own Buyer relating to the said sale.

Prior to the Buyer’s acquiring property in any goods the Seller may at any time by its director, agent or servant enter upon any premises or property upon which it believes such goods may be to view and inspect same and in the event of default by the Buyer (including without limitation default in the payment of the relevant moneys due to the Seller) retake possession thereof.

Notwithstanding that property in any goods that are not paid for remains with the Seller, all risk in respect thereof shall pass to the Buyer upon delivery.

Any quotation made by the Seller is not an offer to sell or to provide services and no order given in pursuance of any quotation shall bind the Buyer until accepted by it in writing or by the commencement of the supply or provision of services.

Once placed, no order may be cancelled by the Buyer except in writing and then only with the prior consent of the Seller. Deposits are non refundable. A store credit will be issued if approved.

The prices of Goods shall be EX warehouse and shall be specified in the Seller’s price list current at the time of invoice by the Seller which prices and list may be varied by the Seller at any time without notice. Unless we state in writing to the contrary the price does not include GST or installation. The Seller reserves the right to charge freight at an amount determined from time to time at the Seller's discretion. Unless a price is stated in writing to include GST, the Seller will, in addition to the price for a supply, charge the Buyer any GST which may be payable in respect of that supply.

Invoiced amounts which have not been paid as aforesaid may attract an interest charge at the rate of interest pursuit to Section 39A of the Local Courts (Civil Claims Act) from the date when such payment fell due until paid and notwithstanding any agreement or extension of time for payment. Where payments are overdue L&P may at its option either cancel uncompleted contracts or orders forthwith or suspend delivery of goods yet to be delivered. Nett 30 days from invoice date unless otherwise stated.
From 1st July 2008 all Amex transactions will incur a 3% settlement fee.

L&P shall retain title to any goods supplied until it has received full payment for them. This does not affect L&P’s right as an unpaid seller. If payment is overdue, L&P shall be entitled to repossess goods belonging to it and to enter any premises without notice for this purpose. If goods belonging to L&P are sold or disposed of by the purchaser, they shall be deemed to have been sold or disposed of by the Purchaser as agent for L&P. Any such sale or disposal by the Purchaser shall be on commercially reasonable terms. Where the goods are sold or disposed of by the Purchaser or are destroyed or damaged while still in the ownership of L&P, L&P shall be entitled to trace the sale or insurance proceeds. L&P shall also have the right to appropriate payments by the Purchaser to such goods and accounts as it thinks fit, notwithstanding any allocation by the Purchaser.

Goods supplied by the Seller to the Buyer shall have the benefit of any Warranty given by the Manufacturer, however, subject to the Trade Practices Act, the Seller shall not be liable for any damage direct, or consequential arising out of any defects. All other Conditions hereby expressly negated so far as they lawfully can be.

Please choose carefully as you are not entitled to a refund if you simply change your mind. Keep your receipt as proof of purchase.

The Buyer shall be responsible for inspecting the goods immediately upon delivery to ensure that the goods are those ordered by the Buyer. The Buyer's responsibility shall not in any way be diminished or extinguished in the case of goods which are delivered to a third party at the direction of the Buyer. All claims must be submitted in writing within 7 days of receipt of goods. We will offer a store credit or exchange (but not a refund) for any unopened goods from stock, returned within 7 days of purchase. Goods will incur a 10% restocking fee. The Seller is not responsible for any other costs, losses or damage arising whether directly or indirectly. No refunds except in accordance with the Trade Practices Act 1974. A refund cheque will be issued if deemed in accordance with the Trade Practices Act 1974.

The Seller shall not be liable for any delay or failure to perform its obligations if such failure was caused by any event for which the Seller could not reasonably have exercised control.

Where the Seller agrees to store or hold on consignment goods on behalf of the Buyer, all risk remains with the Buyer. Any goods so held are to be insured for full purchase value by the Buyer.


Your property: L&P will not be held responsible for the loss or theft of any property of any person using the studio. All care will be taken by L&P and it’s staff to supervise the studio. All clients are required to secure their personal property. Property left in the studio or showroom overnight are left at the clients own risk. Clients are advised to ensure their insurance covers them in the premises.

Bookings must be confirmed 48hrs in advance with Deposit of $150 paid. The full amount is to be paid at the commencement of hire. Cancellation of a confirmed booking will result in non refund of deposit.
